Counsel of record.

Counsel of record is engaged on a per-jurisdiction basis from a panel of senior commercial litigators with substantive prior engagement against regulated payment service providers. Engagement is matter-specific; the firm is not a referral relationship with any single law firm.

Selection criteria

Counsel is selected on the basis of substantive prior engagement against regulated PSPs in the relevant jurisdiction, demonstrated familiarity with the supervisory architecture of the home Member State, capacity to conduct proceedings in the named forum, and absence of any conflict relating to the counterparty.

Per-jurisdiction posture

Where the merchant services agreement specifies an exclusive forum, counsel is selected in that jurisdiction. Where the forum is non-exclusive and the firm has standing options, the panel is reviewed against the structural facts of the file. Disclosure

The identity of counsel of record on an individual file is disclosed to the merchant on engagement. The firm publishes panel firms on this page only with the consent of the relevant panel firm and where active-matter sensitivity does not preclude disclosure; where consent is withheld or sensitivity precludes disclosure, the firm acknowledges the omission rather than misrepresenting the position.

Conflicts

A formal conflicts check is run on counsel selection at file intake. Counsel that holds a prior or current engagement with the counterparty is replaced unless the merchant gives informed written consent and counsel confirms in writing that no privileged information will flow.
